It’s Pride month! It’s that one month every year where those of us in the LGBTQ+ community are recognized and celebrated, and we’re excited about it!
Pride is exciting and everyone can get swept up in their plans, but when planning your weddings, travel, home purchases, babies, etc., it’s important to ensure that while you hope for the best, but plan for the worst. Far be it from me to be the pessimist in the room, but after 45 years of life, (a few) marriages, 3 kids, and 19 years practicing family law – I’m a realist.
Here are a few items to add to your planning checklist to ensure that your family’s needs are protected. I can’t think of anything that fills me with more Pride than ensuring that my family is safe, secure, and happy.
Here are a few tips to get you started
• Planning a wedding? Don’t forget a prenup! Prenups are a great way to ensure that your premarital assets stay exclusively yours or to build a financial structure that you and your future spouse are both are comfortable with for your marriage (not just in the event of divorce). This could be especially important if you have a business, or children from prior to your marriage and/or are blending families.
• Planning a baby? Don’t forget about parentage! Look at NJ statutes because every state is different. If you have a donor (first ensure they are really considered a donor under the NJ statute), make sure you still do a confirmatory adoption – there’s even a simpler version just for us in the NJ statute now! (YES do this if you are married….it’s a belt & suspenders kind of situation). Not married but have kids together? Let’s make sure you’ve got all your duck(ling)s are in a row.
• Planning….anything else? Don’t forget to put a life insurance policy in place, prepare a will, & set up powers of attorney! Good catalysts to work on this are travel, Covid, and just regular day-to-day life. Make sure your family doesn’t have even more to handle if they are already managing emotional loss. These items are for every day…(not just for if you decide to go bungee jumping).
